DIY-EFI LTD: TERMS & CONDITIONS OF SALE
1. GENERAL PROVISIONS & PRODUCT CLASSIFICATION By purchasing from DIY-EFI Ltd, you (“the Customer”) explicitly agree to these Terms and Conditions. All products, hardware, circuit boards, and modified components supplied by DIY-EFI Ltd are sold strictly as DEVELOPMENT KITS, PROTOTYPES, OR FOR RESEARCH AND DEVELOPMENT PURPOSES ONLY. They are not certified consumer electronics or homologated vehicle parts.
2. AUTOMOTIVE & ENGINE MANAGEMENT COMPONENTS
2.1 Off-Road and Motorsport Use Only: All engine management systems (ECUs) and associated wiring are sold strictly for off-road, motorsport, or closed-circuit use. They are not legal for use on public highways. Installation may violate emissions regulations and void vehicle insurance.
2.2 Installation Competence: Engine controllers dictate safety-critical functions. Incorrect wiring, installation, or tuning can result in engine failure, vehicle fire, or severe injury. Installation must be performed by a competent automotive electrical engineer.
2.3 Tuning Liability: DIY-EFI Ltd provides hardware. Any software, firmware, base maps, or default configurations provided are strictly for testing connectivity. They are NOT safe to drive on. The vehicle must be professionally tuned. We accept zero liability for engine damage, melted pistons, blown bearings, or subsequent vehicle damage resulting from incorrect fuel/ignition mapping or hardware failure.
3. HIGH-VOLTAGE MODIFICATIONS (GAGGIUINO)
3.1 Lethal Voltage Warning: Modifying espresso machines involves direct exposure to 230V AC MAINS VOLTAGE, water pressure exceeding 9 bar, and temperatures above 100°C.
3.2 Installer Competence & Risk Assumption: Improper installation of solid-state relays, logic boards, or wiring can result in fatal electric shock, thermal runaway, fire, or steam explosion. Components must only be installed by individuals with formal electrical safety knowledge. If you lack this competence, do not attempt installation. By commencing installation, you assume 100% of the risk.
3.3 Voiding of Warranty & Certification: Modifying a domestic appliance will instantly void the manufacturer’s warranty and invalidate its CE/UKCA safety certification. DIY-EFI Ltd accepts no liability for damage caused to the host machine, your property, or the electrical infrastructure of the premises where the modification is installed.
4. LIMITATION OF LIABILITY
4.1 Statutory Carve-Out: Nothing in these Terms shall limit or exclude DIY-EFI Ltd’s liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.
4.2 Cap on Damages: Subject to clause 4.1, and to the maximum extent permitted by UK law, DIY-EFI Ltd’s absolute maximum liability for any claim, defect, or hardware failure is strictly limited to the original purchase price of the specific component supplied.
4.3 Consequential Loss: Under no circumstances shall DIY-EFI Ltd be liable for consequential, incidental, or secondary damages, including but not limited to:
- Damage to host engines, vehicles, or coffee machines.
- Property damage, fire, or water damage.
- Loss of income, loss of track time, towing/recovery fees, or third-party diagnostic labour.
5. INDEMNITY By purchasing, installing, or operating any product supplied by DIY-EFI Ltd, the Customer agrees to fully indemnify, defend, and hold harmless DIY-EFI Ltd, its directors, and employees against any and all claims, damages, liabilities, costs, and legal fees arising out of the Customer’s use, misuse, incorrect assembly, or improper installation of the products.
6. CANCELLATIONS, RETURNS, AND REFUNDS
6.1 Statutory Right to Cancel: In accordance with the Consumer Contracts Regulations 2013, you have the right to cancel your contract within 14 days of receiving your goods without giving a reason. To exercise this right, you must inform DIY-EFI Ltd via a clear statement (e.g., email) within this 14-day window.
6.2 Condition of Returns & “The Soldering Rule”: Items must be returned in their original, resalable condition.
- Unopened Items: A full refund will be issued for items returned in their original, sealed packaging.
- Diminished Value: You are permitted to inspect the goods as you would in a retail environment. However, if the value of the goods is diminished by any amount as a result of handling beyond what is necessary (e.g., soldering, trimming leads, applying thermal paste, or mounting), no refund will be issued.
- Once a board has been soldered or a wiring harness modified, it is considered “permanently altered” and is non-returnable under standard cancellation rights.
6.3 Faulty Goods (Dead on Arrival): Under the Consumer Rights Act 2015, you have a statutory right to a refund, repair, or replacement for faulty goods.
- Notification: You must notify us of any suspected manufacturing defects within 30 days of receipt.
- Verification: We require high-resolution photographs of the installation and wiring before authorizing a return.
- Testing: Returned items will be bench-tested. If a manufacturing defect is confirmed, we will provide a repair, replacement, or full refund at our discretion.
- User Error: If testing reveals the fault was caused by user error (e.g., reverse polarity, over-voltage, electrostatic discharge, or poor soldering), the warranty is void. In such cases, the customer is responsible for all shipping costs and any diagnostic fees.
6.4 Digital Content: In accordance with statutory exceptions, the 14-day cancellation period does not apply to digital content (e.g., firmware, software licenses, or tuning files) once the download has commenced or a license key has been issued. By purchasing digital content, you expressly consent to waive your right to the 14-day cancellation period.
6.5 Return Shipping: The customer is responsible for the cost of returning goods under the 14-day cooling-off period. DIY-EFI Ltd recommends using a tracked and insured shipping service; we accept no liability for items lost or damaged in transit to us.
7. INTELLECTUAL PROPERTY All PCB designs, code, and documentation are the property of DIY-EFI Ltd. Purchasing a kit does not grant you the right to reverse-engineer, clone, copy, or redistribute our hardware or manuals for commercial gain.
8. GOVERNING LAW These terms are governed by the laws of England and Wales. Any disputes will be handled exclusively in the courts of England.
